1 · Who you're dealing with
Ermes, available at getermes.ai, is operated and sold by DMT SP. Z O.O. (DMT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ), with its registered office at ul. Budowlanych 1A, 62-081 Baranowo, Poland, entered in the National Court Register under KRS 0000836521, NIP 7812007881, REGON 385877414. DMT SP. Z O.O. is the legal contracting entity and merchant for Ermes, and is responsible for Ermes payments. In the rest of this page, “we”, “us” or “Ermes” means that company and the Ermes service it operates.
2 · Your account
To use Ermes you need an account. Keep your login safe. You're responsible for what happens through your account; if something looks wrong, write to us and we'll help.
3 · What your agent is
Your agent is software running in managed private infrastructure provisioned for you. In the BYO plan, it uses the eligible ChatGPT connection you provide; the model provider's own terms and limits also apply. It does what you ask, with the permissions you grant. It can be wrong. Don't use it for anything where being wrong would be catastrophic (life-or-death medical decisions, legal advice you can't double-check, irreversible financial moves) without verifying.
4 · How not to use it
Don't use Ermes to do things that are illegal where you live or where the server is, to harm other people, to break into systems you don't own, to send spam or scams, or to generate content that exploits children. We'll suspend accounts that do these things and we'll cooperate with law enforcement when legally required.
5 · Billing & cancellation
The free trial lasts 7 days and does not require a card. BYO is the first paid plan, planned at $20 per month; it requires your own eligible ChatGPT subscription, which you pay for separately. Hosted is coming soon and is not available to purchase. Paid checkout is temporarily closed while we complete production billing setup. When subscriptions are available, they are billed monthly in advance. You can cancel any time; cancellation takes effect at the end of your current billing period and you keep access until then. We don't refund unused time unless applicable law requires it. Current availability and prices are listed on the pricing page.
6 · Data & privacy
How we handle your data is described on the Privacy page. Conversation and memory data live primarily in the managed private environment assigned to your agent. We use a small number of sub-processors to run the platform, listed plainly. You can export or delete your data using the controls we provide.
7 · What belongs to whom
Your stuff — your prompts, your agent's memory, and the content your agent produces for you — remains yours. We don't use it to train our own general-purpose models. Our stuff — the Ermes platform, brand, and documentation — stays ours. We grant you a normal, non-transferable right to use the platform while your account is active.
8 · Changes to the service
We'll keep adding things and fixing things. If we make a material change that affects how the product works for you (pricing, sub-processors, security commitments), we'll email you with at least 30 days notice so you can react.
9 · Warranty & liability
We work hard to keep Ermes up, secure, and useful, but we can't promise it will be perfect. The service is provided “as is” to the extent allowed by law. Our total liability for anything related to Ermes is capped at twelve months of fees you actually paid us (or, during the free trial, at one hundred euros). Statutory consumer rights that can't be limited stay intact.
10 · Ending things
You can leave whenever you want. We'll wipe the server within 7 days. If you break the rules in §4, we can suspend or close your account; we'll explain what happened and, where reasonable, give you a chance to fix it first.
11 · Governing law
The laws of Poland govern these terms. Courts with jurisdiction under Polish law will hear disputes that we cannot resolve another way. If you're a consumer, you keep any mandatory consumer-protection rights that apply where you live; these terms don't override them.
